We recently tried and won a case for a man on a labor crew who sustained ankle, elbow, wrist, and head injuries when he fell twelve feet from a construction site's temporary walkway. A section of the plywood from the temporary walkway platform was improperly removed and replaced, not done accordingly to the applicable building code. The fall resulted in fractured right ankle, fractured right (dominant arm's) elbow and wrist, closed head injury, and a torn right knee meniscus. It was determined that the client is now unemployable due to his chronic pain syndrome and physical limitations.
The jury returned a verdict for the plaintiff in the amount of $2.032 million. A. G. v. City N.Y. N.Y.C. Board Education, N.Y.C. School Construction Authority, L&B Construction NY, Inc., and Famous Waterproofing, Inc.
