Stryker Litigation Moves Toward Mediation and Potential Settlements

Stryker Rejuvenate and ABG II Modular Hhip Stem Litigation was recently coordinated in front of Judge Martinotti in the Supreme Court of New Jersey, Bergen County. Judge Martinotti is also handing the DePuy ASR litigation.

In an unprecedented move, on April 2, 2013, both sides entered into an Initial Mediation Consent Order. This basically puts all of the cases on the fast track towards a mediation program that could produce settlements in the near future. Specifically, both sides have agreed to a list of mediators and plaintiffs’ counsel will indicate whether or not the plaintiff would like to participate in the mediation program.

In order to participate in the mediation program, the lawsuit must be filed and all medical records must be exchanged with the defendant. We will update everyone on the progress of the first cases to go to mediation to see if any settlements are produced.

This is good news to all as this may mean that a settlement will be produced sooner rather than later.
