Lack of Electronic Stability Control (ESC)

This essential safety system that is designed to prevent loss of control and vehicle rollover, and has been widely available since 1999.  A recent study of the Insurance Institute for Highway Safety (IIHS) found that if all vehicles had ESC it could prevent 10,000 fatal crashes each year.  Any vehicle involved in a rollover accident that was manufactured after 2000 that was not ESC-equipped may be defective.  The later a vehicle without ESC was produced (i.e., 2004, 2005), the stronger the potential liability case.
