Our firm, in association with others, is handling over 100 lawsuits for women who had serious and sometimes fatal injuries from the use of the NuvaRing, a contraceptive device used vaginally. The suits are for clotting caused by the hormones, resulting in:
*pulmonary embolism
*stroke
*deep vein thrombosis.
Our cases are filed in a number of states, including New Jersey and Missouri, both in the state and federal courts. We have obtained a court order against the seller of theNuvaRing, Organon, to turn over their entire files on the product, including all side effect reports. These may amount to more than two million documents. From there our group will proceed to ask employees questions about their conduct.
Some of our cases also involve medical malpractice on the part of doctors or clinics who prescribed the NuvaRing. These involve prescribing for women who already had clotting problems, or who were at high risk otherwise for clotting. Many doctors are making off-label uses of the drugs, other than for contraception.
The two hormones in the NuvaRing are ethinyl estradiol and desogestrel. The latter is a progestin, and has been cited in articles from the 1990s as one more likely to produce thrombosis and clotting in users than other progestins which work just as well as contraceptives.
In 2001, the U.S. Food and Drug Administration approved NuvaRing, a flexible vaginal ring used to prevent pregnancy. Like certain other third generation contraceptives, NuvaRing contains desogestrel—a synthetic progestin. Oral contraceptives containing desogestrel are associated with an increased risk of blood clots. In February 2007, the consumer watchdog group Public Citizen petitioned the FDA to ban a number of contraceptives containing the synthetic hormone.
Was NuvaRing proper for you?
Before a women receives hormonal birth control, medical advice is needed in order to determine if she is an acceptable candidate. To decide this, a doctor needs to understand her medical history and balance the risks and benefits of prescribing her hormonal birth control, such as NuvaRing. Your potential claim can be evaluated as a medical malpractice claim, which is a legal action against the healthcare provider who prescribed the medication. We will be glad to confidentially address this issue with you. A medical malpractice suit can be filed when it appears the balancing of the risks and benefits to a patient was not appropriate. A lawsuit can include both a product liability suit against Organon and a medical malpractice claim.
Injured by NuvaRing?
You are not alone. Various forms of birth control, including the Ortho Evra patch, have raised concerns among users and those in the medical community because of the serious health effects associated with their use. In fact, Ortho Evra is currently the target of numerous personal injury and wrongful death lawsuits.
If you or your loved one has suffered a severe side effect such as blood clot or stroke while using NuvaRing, you too may be able to seek a legal remedy. Contact us today to learn more about your legal rights in a free, private consultation.
