Our firm has filed a number of suits for women who sustained clotting injuries due to the use of Ortho Evra, the birth control patch made by Johnson and Johnson. These suits are part of national litigation which is moving toward settlement of the cases.
The injuries involved in the cases we are handling are:
* pulmonary embolism
* stroke

Most of the clients whom we represent were injured before warnings were given in 2005 to doctors that in fact the Ortho Evra patch over time released a higher level of hormones than the birth control pill. This is the so called "area under the curve." The records obtained from the manufacturer's files show that the company was aware of the risks but did not warn adequately. Since the Ortho Evra patch remains on the market, we are willing to review the facts of injuries in the past two years, but in light of the increased warnings.
In November 2005, the FDA directed the seller of the patch, Johnson & Johnson, to add this information to its labeling. Based upon these disclosures, Public Citizen, a non-profit organization in Washington D.C., stated that women should not use the patch. At the same time, college clinics and other health clinics started cutting back on their prescribing of the product.
