Litigation is developing for serious side effects due to the use of the drug Trasylol, generic name asprotinin, made by Bayer. This is sold for use during surgery to reduce bleeding. The main use is in open heart surgery. An FDA report in September 2006 revealed a large number of complications associated with the use of Trasylol, including stroke, heart failure and death. It is the kidney damage, however, which appears to be a serious side effect which was not well warned by Bayer.
A prime example of a case we would consider for suit would be the development of acute renal (kidney) failure right after surgery, leading to long lasting injuries. We have to study records to seek to eliminate pre-existing causes of this condition. One legal argument open to make is that there are other, less risky drugs available to accomplish the same benefits as Trasylol.
