BEXTRA LITIGATION
We are actively on the lookout for good cases to sue on where users have been injured by Bextra (valdecoxib). This is the pain reliever made by Pfizer which was forced off the market by The FDA in October 2005.
There are three types of injuries which we bringing suits for:
– Heart attacks, where the drug caused a clot in a coronary artery.
– Strokes, due to clots, leading to insufficient blood flow to the brain.
– Stevens Johnson Syndrome, which is a serious skin disorder, and other types of skin reactions.
The Stevens Johnson Syndrome injury (SJS) is attributed to the sulfa molecule in the Bextra formula, and presents a special risk to anyone who has had a previous sensitivity to sulfa medication. SJS can produce horrible injuries to the body. One of our clients has many areas of her body, including her eyes, damaged permanently.
Our vision for the Bextra litigation
We know of course that many lawfirms are seeking to represent persons injured by the use of Bextra. We would like you to know the special ways in which we view handling this litigation.
We are filing our Bextra cases here in New York where Pfizer is located. That way we can maintain directly control of them. Our firm along with others are acting as a steering committee for the litigation. This is not a class action. Each case is handled individually, but common costs are shared and thereby minimized for our clients. Based on medical articles and consultants, we believe we can show that Pfizer was well aware of the risks of heart attacks long before it took Bextra off the market.
We have also been in discussions with Pfizer about the rapid settlement of SJS cases, since the company did not warn doctors, or the public, about the special risks involved with this disease.
We handle the Bextra cases on a contingent fee basis. We do not charge a prospective client for the costs of obtaining records and going to one of our specialist consultants for analysis of the records. We only get paid at the end of the case if a client gets a settlement, and we then take a percentage as a fee.
Paul is on the plaintiffs' steering committee which governs the handling of Bextra cases in New York. Our firm has also been active in educating other lawyers about how to recognize a good case medically. Paul Rheingold and Hunter Shkolnik have lectured to large audiences of lawyers on the analysis of these cases. Paul had also written a major article on how to deal with proof issues relating to use of Bextra, as well as three other articles on this litigation.
