We have filed a number of cases for women who developed pulmonary embolisms or deep vein thrombosis while using Ortho Evra, the birth control patch. This is the patch which is linked to a greater incidence of clotting injuries (pulmonary embolism, deep vein thrombosis, stroke and heart attack) than oral contraceptives. Legal investigation in these cases reveals a pattern of concealment of risks by Ortho-McNeil, a subsidiary of Johnson & Johnson.
The clearest cases on liability are those before the warnings were strengthened, which was November, 2005. That change in labeling added that there was a possible increase in blood clot risk. On September 20, 2006, the FDA announced that Ortho Evra labeling would be further supplemented to add the results of two recent studies, one of which found the clotting risk to be double that of birth control pills.
We are filing our cases in the federal court system where they are consolidated with others pending around the country. This procedure saves costs, since all of the cases are prepared at one time. Each case remains an individual action so far as our control goes.
