Car Insurance Company Files Lawsuit Over SUA

Allstate Insurance company filed suit against Toyota seeking $3 million in compensation for 270 claims they have paid out since 2007 they believe are related to Sudden Unintended Acceleration. The suit was filed after subrogation negotiations outside of court failed. This is believed to be the first subrogation lawsuit filed against Toyota related to Sudden Unintended Acceleration (SUA).
The suit says, "certain of Toyota's cars and trucks have a defect that causes sudden uncontrolled acceleration to speeds of up to 100 miles per hour or more" and that those vehicles have, "defective electronics and the absence of a fail-safe, such as brake-to-idle override system."
Several other insurers including State Farm and Farmers are currently in negotiations with Toyota to settle their subrogation claims.
