Governor Cuomo Extends Child Victims Act For Survivors of Sexual Abuse

By Rheingold Giuffra Ruffo Plotkin & Hellman LLP

Governor Andrew Cuomo announced today that he has extended the Child Victims Act until January 14, 2021. The Act was scheduled to expire on August 14, 2020, until the Governor extended the deadline due primarily to the coronavirus.

NY courts had been prepared to handle an onslaught of civil sexual abuse lawsuits prior to the pandemic’s arrival in March of this year. However, the pandemic shut down the court system, prohibiting any new filings. With a little more than three months before the August deadline, Governor Cuomo did the right thing and ensure every survivor of childhood sexual abuse previously barred by the statute of limitations, may have an opportunity at justice.

About the New York Child Victims Act

The Child Victims Act was signed into law by Governor Cuomo after a decades-long battle to address the issue. Many survivors of Catholic priest abuse, Boy Scout abuse, and school teacher abuse had never come forward within the normal time frame of the statute of limitations primarily because they were children when the abuse occurred and the extreme emotional trauma they experienced in coping with the aftermath of such abuse.

We have worked for many years now assisting survivors to find their voice and seek justice. It’s never been easy but it is one of the most worthwhile causes in which we’ve been involved as attorneys. We have represented adult survivors of abuse, primarily concerning the sexual abuse of Harvey Weinstein that helped give birth to the #MeToo movement. We are proud of that work and look forward to assisting survivors who were abused as children. Now that we have a bit more time, we urge all survivors of sexual abuse to muster their inner courage and come forward. we want to help you seek justice and more importantly, healing. Recovery is possible and we pledge to help you every step of the way. Presently, we am working on civil lawsuits that have already been filed in the state of New York. We have lawsuits in Manhattan, Brooklyn, Ogdensburg, and Rockville Centre.
