The law acknowledges recovered financial compensation for injured firefighters (General Municipal Law Section 205-a) and police officers (General Municipal Law Section 207-c), including lost wages, property damage, pain and suffering, as well as worker’s compensation.
General Municipal Law 205-a provides an injured firefighter with a cause of action to recover damages from any person who, at the time of injury, is guilty of the negligent or willful failure to comply with a statute, ordinance, rule, etc. The firefighter is permitted to recover a sum greater than $10,000 and in the case of death a sum greater than $40,000.
General Municipal Law 207-c provides an injured police officer with the right to recover from his jurisdiction, municipality or state for injuries caused by a third person. Pursuant to subsection (6), the municipality has a cause of action against the third person for reimbursement or any salary, wages, medical treatment and/or hospital care.
