New York Mass Tort Attorneys

Representing Clients Nationwide

When multiple people are injured as a result of a defective product or due to some other form of negligence in which there is one liable party, the victims can take collective legal action by filing what is known as a mass tort. A mass tort claim is similar to a class action with one key difference: while claimants in a class action seek a single settlement or verdict to be divided among all participants, a mass tort allows each claimant to seek specific damages. This is useful for cases involving defective drugs and medical devices, as these products tend to injure victims in different ways, leading to vastly different damages for each affected individual.

If you believe you may have grounds for a mass tort claim, or if you were injured by a defective product that has caused widespread harm, reach out to our New York mass tort attorneys to learn more. At Rheingold Giuffra Ruffo Plotkin & Hellman LLP, we proudly represent clients nationwide in complex mass tort litigation and have a proven record of success. What Is a Mass Tort?

Mass torts are a type of civil legal action (as opposed to criminal action) that allow multiple plaintiffs to take action against a single defendant. These types of lawsuits arise when the actions of the single plaintiff cause injury or harm to large groups of people.

As previously mentioned, mass torts are similar to class actions. However, unlike class action lawsuits, mass torts allow individual claimants to recover damages that are specific to their losses. Because each member of the mass tort claim is treated as an individual, this also means that each individual must prove their case, including their damages.

What Is the Purpose of Filing a Mass Tort?

Ostensibly, mass torts offer a method of reducing the total number of claims filed. Rather than filing many separate lawsuits against a defendant, multiple affected individuals can file a single lawsuit, which lowers the number of cases traveling through the court system.

One of the advantages of filing a mass tort is that it allows you to recover for your specific damages, rather than receive a portion of a single settlement or verdict, as is the case in successful class action lawsuits. Mass torts also typically involve fewer plaintiffs, or affected parties. Because these types of cases often do not follow standard legal procedures, it is absolutely critical that you work with an experienced attorney who can help you understand your options and help you navigate the legal process.
