Successful Appeal - Defective Tire Case - Alexander v. Dunlop
Written By: Rheingold, Giuffra, Ruffo & Plotkin LLP
In a recent decision in the Supreme Court, Appellate Division, Third Department, Rheingold, Giuffra, Ruffo & Plotkin LLP successfully argued to have a dismissal overturned in a case involving a defective tire. We commend our Appellate Partner Paul Rheingold for their work. We now believe our clients will get their fair day in court.
The firm is looking forward to the trial in Binghamton, NY. We expect this be sometime in late 2011 or 2012 before the Honorable Jeffrey A. Tait in Broome County Supreme Court.
The case involves a product liability claim involving a blown Dunlop tire which we allege failed due to tread separation. Our firm prepared the case and prosecuted it vigorously with experts. Tread separation comes from improper manufacturing. This is known as an "adhesion/cohesion" failure.
